Site. These terms and conditions are subject to change
without prior notice at any time, in accessorygenie.com’s

These terms and conditions constitute a legal contract

“you” or “your” shall relate
to a customer of accessorygenie.com or any other party

browsing, shopping, accessing or otherwise using this
site, you acknowledge that you have read, understood,

SALES:
California, USA residents please add 8.25% sales tax.
We accept PayPal funds, Visa and Mastercard. NO personal
or business checks please. Your receipt of an electronic
or other form of order confirmation does not signify
our acceptance of your order, nor does it constitute
confirmation of our offer to sell. Accessorygenie.com
reserves the right at any time after receipt of your
order to accept or decline your order for any reason.
Accessorygenie.com reserves the right as any time
after receipt of your order, without prior notice
to you, to supply less than the quantity you ordered
of any item.
SHIPPING:
We ship via USPS to the 48 continental United States,
Alaska, Hawaii, Puerto Rico, Canada, and many other
Internation destinations. Shipping methods and rates
are selected by the customer and are verified at checkout.
International orders are subject to incremental customs
charges. Shipping fees are non-refundable. Pickup
from our warehouse locations is not available. Shipping
rates are determined by both weight and destination
postal code. Paid and verified orders, which are in-stock,
ship within 48 hours. If you have any questions please
ask.
DISCOUNTS/ GIFT CERTIFICATES/ COUPONS:
We welcome all our customers to use their discounts
when purchasing products at our web site. Any discounts,
gift certificates, or coupons must be claimed at time
order is placed. Please use the appropriate place
on order form at checkout to claim your discount.
Accessorygenie.com will be unable to apply any discount
to orders which have already been placed.
PRODUCT DESCRIPTIONS
Accessorygenie.com attempts to be as accurate as possible.
However, accessorygenie.com does not warrant that
product descriptions or other content of this site
is accurate, complete, reliable, current, or error-free.
If a product offered by accessorygenie.com itself
is not as described, your sole remedy is to return
it in unused condition.
PRODUCTS GUARANTEES, DISCLAIMER AND LIMITATION OF
LIABILITY:
Products are only covered by manufacturer guarantees
and/or warranties. We always do our best to notify
customers of these guarantees and warranties. After
30 days defective product must be returned to the
manufacturer. Except as expressly stated herein, accessorygenie.com
makes no representations or warranties, either express
or implied, of any kind with respect to products sold
on the accessorygenie.com sites. Except as expressly
stated herein, accessorygenie.com expressly disclaims
all warranties, express or implied, of any kind with
respect to products sold on this site, including but
not limited to, merchantability and fitness for a
particular purpose. You agree that the sole and exclusive
maximum liability to accessorygenie.com arising from
any product sold on the accessorygenie.com sites shall
be the price of the product ordered. In no event shall
accessorygenie.com, its directors, officers, employees
or other representatives be liable for special, indirect,
consequential, or punitive damages related to product
sold
TYPOGRAPHICAL ERRORS:
In the event a product is listed at an incorrect price
or with incorrect information due to typographical
error or error in pricing or product information received
from our suppliers, accessorygenie.com shall have
the right to refuse or cancel any orders placed for
product listed at the incorrect price. Accessorygenie.com
shall have the right to refuse or cancel any such
orders whether or not the order has been confirmed
and your credit card charged. If your credit card
has already been charged for the purchase and your
order is canceled, accessorygenie.com shall immediately
issue a credit to your credit card account in the
amount of the charge.
DAMAGE:
Damages are the responsibility of the carrier once
the shipment has been released from accessorygenie.com.
After shipment is released to the carrier, any damages
must be reported to sccessorygenie.com within five
days from receipt of shipment. All claims must be
filed by accessorygenie.com with the freight carrier.
The customer must save all boxes and packing materials
for damage inspection by carrier.
RETURNS/EXCHANGES:
Each product is fully guaranteed by the manufacturer
(unless specifically stated otherwise). The complete
warranty is included with the product. The manufacturer's
warranty covers repair or replacement of defective parts,
subject to the conditions set forth. On most items,
Accessory Genie offers an exclusive 30 day return policy.
All returns require a Return Merchandise Authorization
(RMA) number, which you can obtain by emailing Accessory
Genie customer service at returns@accessorygenie.com
or by calling 888-998-8879 (Monday through Friday,
9 a.m. to 6 p.m. Pacific Time). Please note your order
number, item #'s of products being returned, and the
reason for return. RMA numbers remain valid for 30
days. Please return your merchandise promptly after
receiving an RMA number.
All returns must be shipped with the RMA number clearly
displayed on the outside of the shipping box. All
returned product must be complete with the original
manufacturer's packaging and any parts, cords, or
manuals. Non-defective items, open merchandise, and/or
incomplete returns are subject to a 20% restocking
fee. Please allow 14 business days to process the
return after it arrives at our warehouse. Any merchandise
returned to Accessory Genie without authorization
or a RMA number will be refused.
Defective Merchandise - Defective
merchandise may be returned within 30 days of purchase
for exchange, refund, or store credit.
Non-Defective Merchandise - Non-defective
merchandise may be returned within 30 days of purchase
for exchange, refund, or store credit. Non-defective
items, open merchandise, and incomplete returns are
subject to a 20% restocking fee.
Outgoing shipping charges are not refundable under
any circumstance. Canceled orders are subject to a
cancellation fee. Accessory Genie reserves the right
to refuse any return. An RMA number does not guarantee
final disposition. All returns are subject to inspection.
JURISDICTION AND VENUE
You agree that any legal action brought against accessorygenie.com
shall be governed by the laws of the State of California
without regard to its conflict of law principles.
You agree that the sole jurisdiction and venue for
any litigation arising from your use of or orders
made on the accessorygenie.com sites shall be an appropriate
federal or state court located in Ventura County California.
SITE POLICIES, MODIFICATION, AND SEVERABILITY
Please review our other policies, such as our privacy
policy, posted on this site. These policies also govern
your visit to accessorygenie.com. We reserve the right
to make changes to our site, policies, and these Terms
& Conditions of Use at any time. If any of these
conditions shall be deemed invalid, void, or for any
reason unenforceable, that condition shall be deemed
severable and shall not affect the validity and enforceability
of any remaining condition.
These terms will apply to orders shipping
beginning November 4, 2005.
